How Data Privacy law protects our clients

Data protection law states that we may only process personal data if we have valid reasons to do so. The reasons we process your personal data include, but are not limited to, your consent, provision of a contract, provision of a service, billing and to contact you about your account or service.

How we collect data from clients

We receive information about you when you create a customer account when you place orders for services, complete forms on our website, or if you contact us by phone or email.

If you ask us to provide a service for your client, and so you are providing us with personal data about a third party, then you warrant that you have obtained the express consent from the third party for the disclosure and use of their personal data by Swift Internet and our suppliers.

Your data may be automatically collected when you use our services, including but not limited to, your IP address, device-specific information, software information, web server logs, mail server logs, Internet connectivity logs, device event information, location information and unique application numbers.

What type of data we collect from clients

The personal data that we collect from you includes your name, postal address, e-mail address, telephone numbers, invoicing and payment information and IP addresses. We also store details of your visits to our websites in a log including, but not limited to date/time, traffic data, location data, Web logs Email logs, and other communication data. We also retain records of your correspondence when you contact us or when we contact you.

How we use your data

We use information about you in the following ways:

To create an account with your contact details and preferences.
To process your orders.
To provide you with our products and services.
To provide data to upstream suppliers which are necessary to supply the service to you.
To administer the services we provide to you.
To provide automated reports on the service we supply to you. For example resource usage, software vulnerability reports.
To comply with our contractual obligation.
To help us to identify you and any accounts or services you hold with us.
To enable us to develop and improve our services.
To provide you with support and customer care.
To administer your account, process payments and store billing and payment transactions, for customer service or support correspondence.
To detect fraud.
To notify you about changes to our terms and services;
To inform you of service/product changes or price changes relevant to the services we supply to you.
To carry out marketing and statistical analysis.
To provide you with information about products or services that you request from us or which we feel may interest you, only where you have consented to be contacted for such purposes.

Data retention periods

We will keep your personal data for the duration of the period you are a customer of Swift Internet. Upon the closure of your account, we may keep your data for up to 7 years after you have cancelled your account with us. We may not be able to delete your data before this time due to our legal and compliance obligations.

Who has access to your data

Staff members of Swift Internet have access to your data where necessary for the provision and administration of your services.

In addition, where necessary, your data may be given to our suppliers for the provision of a service or support of a service.

For a domain name registration, the name address and contact details you provide will be supplied to the domain name registrar, and those details may be made public on the whois register for the domain name.

For a connectivity solution, your name, address and contact details may be provided to a telecoms supplier (e.g. BT, OpenReach, and their suppliers) for the provision and support of your service.

We process your data for administration, billing, support and the provision of services.

Additionally, to provide details of SSL certificate owners to the SSL certificate authority for its authentication and use, which may be made public within the certificate.
To provide data to software suppliers for the licensing of software.
Such data may be stored by suppliers outside of the EEA.

We do not and never shall sell your personal data to third parties for the purposes of marketing or advertising.
We may in future transfer your data if we are acquired by or merge with a third party company. In these circumstances, we may transfer your data to the buyer of our business, subject to both parties entering into a confidentiality agreement.

We may share your data if we consider that we have a duty to disclose data in order to comply a legal obligation or to protect the rights, property, or safety of the company or others. This includes but is not limited to exchanging information with other companies and organisations for the purposes of credit risk assessment, fraud protection, and dispute resolution.
We will always take steps to ensure that your privacy rights are protected when information is shared.

Your data protection rights

You have the right to object to our use of your personal data or ask us to delete, remove or stop using your data if there is no reason for us to keep it. This is known as your right to be forgotten.

There are legal and accountancy reasons why we will need to keep your data for a period of time, but please inform us if you think we are retaining or using your personal data incorrectly.

Our Privacy Notice shall be made clear to you at the point of collection of your personal data.
In preventing the use or processing of your personal data, it may delay or prevent us from fulfilling our contractual obligations to you, or from administering your account or service.

You can view, edit or delete your personal data through the Swift Internet control panel. You can also make choices about the collection of your data and how we use it.

You have the right to ask us not to process your personal data for marketing purposes by making a selection at the point of collection. We will not contact you for marketing purposes unless you have given us your prior consent. You can change your marketing preferences within the account control panel.

Viewing and updating your data

You must maintain the accuracy of your information in the Swift Internet account control panel to ensure all your details are correct.

You have the right to access the information we hold about you. Please email your requests to privacy@nullswiftinter.net so that we can assist you in accessing this information.

Use of cookies

Access to our websites may include the use of a “session cookie”. Session cookies are not considered to be an invasion of privacy and merely allow the website to link the actions of a user during a browser session. They may be used for a variety of purposes such as remembering what a user has entered into their shopping basket or remember them as an authenticated user after logging into a private area. These session cookies expire after a browser session so would not be stored long term. For this reason, session cookies are considered less privacy intrusive than persistent cookies and are therefore exempt from “The Privacy and Electronic Communications EC Directive” and so do not require prior user consent.

Links to other websites

We may provide links to third-party websites. Any information that is supplied on these sites will not be within our control and we cannot be responsible for any privacy-related issues when using such sites.

We encourage you to review the privacy policies of any third party websites before entering private data.

Where we store your personal data

We follow accepted standards to store and protect the personal data we collect from you, including the use of data encryption technologies to protect data where appropriate. Strict procedures and security features are in place to try to prevent unauthorised access.

All information you provide to us is stored on our secured servers within our data centre in the UK.

If your information has been transferred to a third party supplier for the provision of your service, then your data may be stored in a country outside the EEA. Example: the registration of non-UK domain names.

Although the transmission of information via the internet is encrypted wherever possible, the internet is not completely secure, so we cannot guarantee the security of your data transmitted to our site and any subsequent transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Any sensitive data (passwords for example) are encrypted and protected.

Where we have given a password to you, or where you have created your own password, you are responsible for ensuring that the password is strong, not used elsewhere, and keeping the password confidential. Do not to share a password with anyone. We may change your password if we believe it is necessary to do so.

Liability

We will take all reasonable measures to protect your data in accordance with applicable laws and in accordance with our General Terms and Conditions and Policies.

In the event of a data breach, we will meet or exceed our obligations under data protection law.

Data which you store using our services

Clients with Server, Website Hosting, and E-mail services are renting server space from Swift Internet for the storage of their own data such as email, websites, databases, documents, images and other media. The client is responsible for all data which they host on our services and agree that they are the controller and processor of that data. The client agrees to comply with their lawful data protection obligations. Any content stored on the service we provide, whether a website, database, email or other media, whether published content or not, is not subject to our Privacy Agreement. Swift Internets servers merely serve such data to the recipient on your behalf, subject to our Terms and Conditions and you are responsible for all legal and data protection requirements in respect of your stored content. You are responsible for maintaining the security of your website and the software on your website to a secure standard by updating the website software to the latest secure versions as and when updates are available.

Swift Internet will take all reasonable measures to ensure that the server hosting your data is secure.
